Commencement notices
Lodgment of a commencement notice gives notice to the building control authority of the intention to erect such buildings, or classes of buildings or the carrying out of such works or classes of works, as may be specified in the regulations.
Commencement notice
The notice must be submitted on the Building Control Management System (BCMS) website not less than 14 days and not more than 28 days before the commencement of the works or the material change of use.
Subject to exemptions, commencement notices are required for:
- The erection of a building
- The material alteration or extension of a building
- The material change of use of a building
- Works in connection with the material alteration (excluding minor works) of a shop, office or industrial building

7 Day notice
Article 20A sets out the procedure for submission of a 7 day notice application to a building control authority where a person intends to commence work on the construction of a building before grant of the relevant fire safety certificate (FSC). This notice must be accompanied by a 7 day notice statutory declaration form which declares that the works will comply with the building regulations and that any modifications required by the Fire Safety Certificate will be completed within the specified time. The notice must be submitted not less than 7 days in advance of commencement of work and must be in accordance with the requirements of Article 20A(2) of the regulations.
A 7 Day Notice application should be considered and a decision made thereon in accordance with the requirements of article 20A (3) and 20A (4) of the regulations.
The regulations amend article 12 so as to provide that a commencement notice will not be required in respect of buildings where a 7 day notice has been submitted.

Fee
The standard fee for a Commencement Notice is €30.00 which is payable online.
The standard fee for a Commencement Notice is €30.00 which is payable online on the Building Control Management System (BCMS) website.
Where the proposed works or the material change of use (as the case may be ) relate to more than one building, the fee shall be €30.00 in respect of each building subject to a maximum of €3800.00.
In determining the fee payable in respect of a commencement notice, a house in a terrace and a semi-detached house are each to be treated as being a separate building.
The Commencement Notice process is in accordance with S.I. No. 9 of 2014 – Building Control (Amendment) Regulations 2014.
A new national Building Control Management System (BCMS) website provides for the completion of a mandatory online assessment, information on the submission of commencement notices, online payment, and frequently asked questions (FAQs).
Note: Where a building control authority makes a refund in respect of the submission of a commencement notice, the refund shall not be such as to reduce the balance of the fee to less than €30.00.
