Defective Concrete Blocks Remediation Privacy Notice
In order to administer the scheme established by the government under the Remediation of Dwellings Damaged by the Use of Defective Concrete Blocks Act, 2022, Clare County Council is required to collect and process certain types of information about applicants for the scheme. The information sought includes ‘personal data’ as defined by the Data Protection Acts and by the General Data Protection Regulation (GDPR) and relates to the personal data of you (as applicant) and members of your household who may also be part of the application.
1.0 - Why do we have this privacy notice?
Clare County Council, as the data controller, has created this privacy statement in order to demonstrate our firm commitment to privacy and transparency.

2.0 - Legal basis for the processing of personal data as part of the application and administration of the defective concrete blocks scheme
The legal basis for the personal data processing by Clare County Council, as a designated local authority under the Remediation of Dwellings Damaged by the Use of Defective Concrete Blocks Act 2022, is provided by article 6(1)(c) and 6(1)(e) of the GDPR.
c) processing is necessary for compliance with a legal obligation to which the controller is subject, namely the Remediation of Dwellings Damaged by the Use of Defective Concrete Blocks Act 2022, and SI/347 of 2023 the Remediation of Dwellings Damaged by the Use of Defective Concrete Blocks, regulations 2023
e) processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the control-ler, such official authority being provided by the Remediation of Dwell-ings Damaged by the Use of Defective Concrete Blocks Act 2022, and SI/347 of 2023 the Remediation of Dwellings Damaged by the Use of De-fective Concrete Blocks, regulations 2023
3.0 - Types of personal data
All the personal data sought as part of the application process is prescribed by the schedule 2 of the government regulation SI/347 of 2023 the Remediation of Dwellings Damaged by the Use of Defective Concrete Blocks, regulations 2023. Schedule 2 prescribes the application form and all the personal data that is required to be processed by the Council. This means that it is a legal requirement to provide the data in connection with making an application under the scheme. The consequence of not providing the data would be to make your application incomplete or invalid.
4.0 - How your personal data will be used/processed by the Council
The personal data you provide with your application under the scheme will be processed for the purposes of administering the defective concrete blocks scheme, as set out in the law and in the regulations, and for no other purpose.
5.0 - Recipients of the personal data
A limited team within the housing section of Clare County Council will have access to your data. A limited number of Council IT section staff would also have access in connection with maintaining Council systems.
The Council’s GIS officer will have access to limited data only, in connection with the mapping of the scheme in county Clare. (Anonymised mapping data only will be published).
Data provided by applicants for the scheme will be stored on a software platform hosted by – submit.com and the processes within the scheme will be managed within the platform.
Your data may be accessed by a limited number of personnel in the software company in the connection with maintaining the software. A formal data processing agreement is in place with Submit.com.
The Housing Agency will be recipients of applicants’ data, namely: completed application forms, building condition assessment reports, remedial works plan, post remediation works report and certificate of remediation, in line with the prescribed scheme. The Housing Agency will process your personal data only to the extent necessary for the prescribed purposes of processing applications, carrying out assessments, issuing decisions and for research purposes.
The Appeals Panel and An Appeal Board established under the 2022 Act may also access your personal data to the extent necessary for prescribed purposes of processing applications, carrying out assessments, issuing decisions and for research purposes.
The Department, the Sustainable Energy Authority of Ireland and the National Standards Authority of Ireland may also process your personal data to the extent necessary for prescribed purposes of processing applications, carrying out assessments, issuing decisions and for research purposes.
For the purposes of processing grants under the scheme, some of your personal data may be shared with the finance department in order to issue a grant payment and in connection with audits.
6.0 - Records retention policy
Clare County Council subscribes to the national policy for retention and destruction of local authority records.
7.0 - Your data rights
You have the right to request access to personal data held about you, rights of rectification and erasure, rights of restriction and objection and rights of portability. 8.0 - Right of complaint to the Office of the Data Protection Commissioner
If you are not satisfied with the outcome of the response you received from Clare County Council in relation to your request or in relation to exercising your data rights, then you are entitled to make a complaint to the Data Protection Commissioner who can investigate the matter for you.
