Derelict Sites Privacy Notice
The purpose of this privacy notice is to describe, in clear terms, the personal data that the Derelict Sites Administration process collects about individuals, why it is needed, the legal basis, how it is used and how individuals may interact with the Council in relation to their personal data and the Derelict Sites Administration. It also outlines the right of individuals under data protection legislation.

1.0 Who we are and why do we require your information
In order to provide the most effective and targeted range of services to meet the needs of the citizens of County Clare, we will be required to collect, process and use certain types of information about people and organisations. Depending on the service being offered, the information sought may include ‘personal data’ as defined by the Data Protection Acts and by the General Data Protection Regulation (GDPR). In addition, staff may be required, from time to time, to collect, process and use certain types of personal data to comply with regulatory or legislative requirements.

Clare County Council creates, collects and processes a vast amount of personal data in various multiple formats on a daily basis. Clare County Council’s commitment is that the personal data you may be required to supply to us is;
- Obtained lawfully, fairly and in a transparent manner
- Obtained for only specified, explicit and legitimate purposes
- Adequate, relevant and limited to what is necessary for the purpose for which it was obtained
- Recorded, stored accurately and securely and where necessary kept up to date
- Kept only for as long as is necessary for the purposes for which it was obtained
- Kept in a form which permits identification of the data subject
- Processed only in a manner that ensures the appropriate security of the personal data including protection against unauthorised or unlawful processing.
3.0 Legal basis for processing personal data in relation to derelict sites
The legal basis are:
- Where the maintenance of the derelict sites register is concerned, Article 6(1) (c) – processing is necessary for compliance with a legal obligation to which the controller (the Council) is subject, in this case the Derelict Sites Act 1990, as amended, and;
- Where the management of derelict sites generally is concerned, including encouraging reporting derelict sites to the Council, Article 6(1) (e) – processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller – in this case the Derelict Sites Act 1990 as amended and the public interest in the management of derelict sites.
4.0 Types of personal data
- Where data subjects are reporting a derelict site, the personal data involved are: name, address, including Eircode, phone number, email address;
- Where the owners or reputed owners or occupiers of derelict sites are concerned, the personal data involved are: name, address including Eircode, map of derelict site, derelict site reference, particulars of action taken by the Local Authority under the Derelict Sites Act, 1990 as amended, particulars of the value of urban land as determined under the Act.
5.0 Purposes of the processing
The personal data will be used for the purposes of:
- Maintaining the derelict sites register, issuing statutory notices to owners/occupiers and corresponding with owners/occupiers;
- Investigating and following up on complaints of or reports of derelict sites, including corresponding with complainants.
6.0 Recipients of the Personal Data
Maintenance of the derelict sites register is a legal requirement and the register is available for public inspection, in accordance with the Derelict Sites Act, 1990 as amended. The Council’s solicitor may be a recipient of data contained on the register. Otherwise, access to the personal data is restricted to relevant staff in the Economic Development directorate of the Council. Any other sharing of the personal data is limited to circumstances permitted by law.
7.0 Records Retention Policy
Entries in the derelict sites register will be retained in the register while active and then removed from the register. Register case files will be retained until resolved. Acquisition/Vesting of Land records will be retained in the case of acquisitions until the completion of the legal process required for the transfer of the land and a further 7 years and then archived. Records of unsuccessful acquisitions will be retained for 2 years.
8.0 Your Data Protection Rights
You have the right to request access to personal data held about you, obtain confirmation as to whether data concerning you exists, be informed of the content and source of data and check its accuracy. In addition, if the data held by us is found to be inaccurate, you have the right to change, remove, block or object to the use of personal data held by Clare County Council. In certain circumstances, blocking access to data may delay or remove access to a service where the data is required by law or for essential purposes related to delivery of a service to you.

9.0 Right of complaint to the Office of the Data Protection Commission
If you are not satisfied with the outcome of the response you received from Clare County Council in relation to your request to exercise your rights under the Data Protection legislation, then you are entitled to make a complaint to the Data Protection Commission who may investigate the matter for you.
